1. Agreement to these Terms
These Terms of Service (“Terms”) govern your access to and use of aiphotoeditingprompts.online and related services (the “Service”), operated by Promptora (“we”, “us”, or “our”). By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Eligibility and accounts
You must be at least 13 years old, or at least 16 where your local law requires a higher age for digital consent, and have the legal capacity to agree to these Terms. If you are under 18, you may use the Service only with the involvement and permission of a parent or guardian. You may browse the prompt library without an account. If you create an account, you may sign in with Google. You are responsible for your account, for all activity that occurs under it, and for keeping your login credentials secure. You must provide accurate information and promptly update it. We may suspend or terminate your account if you violate these Terms or create risk for us or others. You may stop using the Service at any time and may request account deletion by contacting us.
3. The Service
The Service includes a curated library of AI photo editing and collage prompts, example images, guides, and optional account features. Some features may use third-party AI models, credits, or paid plans. Prompts are suggestions, not guarantees: results depend on the model, version, settings, reference images, and other inputs. We may add, change, suspend, or discontinue features at any time. We do not guarantee that the Service will be available, uninterrupted, or error-free, or that any prompt will produce a particular result or style.
4. Prompt library license
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the prompts in our library for your own personal and commercial creative projects. You may copy and adapt prompts for those projects. You may not:
- Resell, sublicense, redistribute, or publish the prompts as a standalone library, dataset, or competing product.
- Scrape, crawl, bulk-download, or systematically extract the library or our example images.
- Use the prompts or library to train, improve, or benchmark a competing AI model or prompt library.
- Remove copyright, trademark, or attribution notices, or use our branding without permission.
- Represent that we endorse you or your outputs without our written consent.
5. Your content
“User Content” means prompts, images, generated outputs, comments, collections, and other materials you submit to the Service. You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free license, including the right to sublicense to our service providers, to host, store, reproduce, process, display, and distribute your User Content as needed to provide, secure, and improve the Service, and to display content you choose to make public. You represent and warrant that you have all rights, permissions, and consents needed for your User Content, including permission from any person depicted in an image. You are responsible for your User Content, and we may remove content that violates these Terms or applicable law.
6. AI-generated outputs
AI outputs may be inaccurate, incomplete, unexpected, offensive, or unsuitable for your purpose. They may also resemble outputs generated for other users, and they may not be original or protectable. We do not guarantee that outputs are copyrightable, non-infringing, exclusive, or fit for a particular purpose. You are responsible for reviewing outputs before using, publishing, or relying on them, and for obtaining any rights, releases, or licenses required for your use. Do not rely on outputs for legal, medical, financial, safety, or other professional advice. Do not use outputs to impersonate a real person, misrepresent identity or endorsement, or mislead others. Subject to applicable law and third-party rights, you own your outputs to the extent permitted by law.
7. Acceptable use
You must use the Service lawfully and responsibly. You may not:
- Use the Service for unlawful, fraudulent, deceptive, or harmful purposes.
- Infringe copyright, trademark, publicity, privacy, or other rights.
- Upload or generate content that sexualizes or exploits minors, or that depicts child sexual abuse material.
- Generate or distribute pornography, explicit sexual content, or other NSFW material.
- Generate or distribute graphic violence, gore, torture, or content that glorifies serious harm, terrorism, or violent extremism.
- Generate or distribute hate speech, harassment, threats, or content that dehumanizes or discriminates against protected groups.
- Create deceptive deepfakes, non-consensual intimate imagery, or content that impersonates a real person without authorization.
- Upload malware, attempt to gain unauthorized access, probe or scan the Service, or interfere with its operation.
- Scrape, harvest, or bulk-download content, or use bots or automated systems without our written permission.
- Circumvent credit, payment, rate-limit, moderation, or access controls.
- Reverse engineer, decompile, or attempt to extract source code, models, or underlying data from the Service, except where the law expressly permits it.
- Resell, sublicense, or provide the Service to third parties as a service, unless we agree in writing.
- Use the Service for high-risk decisions that could cause death, personal injury, or significant harm.
8. Content moderation and enforcement
We may use automated signals and human review to detect prohibited or risky prompts, images, and outputs. We may block a request before generation, remove content, restrict features, issue a warning, suspend or terminate an account, cancel a plan, or remove unused credits. We may preserve and report content or activity when we believe it is necessary to comply with law, protect safety, or investigate abuse. Serious or repeated violations may result in immediate action without prior notice. If you believe we made a mistake, you may appeal by emailing [email protected] with the relevant details. Amounts paid for access terminated because of a violation are not refundable except where the law requires otherwise.
9. Intellectual property
The Service, including our software, design, text, graphics, selection and arrangement of prompts, and branding (“Promptora”), is owned by us or our licensors and is protected by intellectual property laws. Except for the limited license in these Terms, no rights are granted to you. You may not use our trademarks, logos, or branding without our prior written consent. If you send us feedback or suggestions, you grant us a non-exclusive, perpetual, irrevocable, royalty-free license to use them without compensation or attribution.
10. Copyright complaints
If you believe content on the Service infringes your copyright, email [email protected] with the subject line “Copyright Notice” and include: your name, address, telephone number, and email address; a description of the copyrighted work you believe is infringed; the URL or location of the allegedly infringing material; a statement that you have a good-faith belief that the use is not authorized; a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act on the owner’s behalf; and your physical or electronic signature. We may remove or disable access to the material and notify the uploader. We may terminate repeat infringers. If you believe your content was removed by mistake, you may send a counter-notice with the information required by applicable law.
11. Third-party services and AI models
The Service may use third-party hosting, analytics, payment, and AI model providers, and may link to third-party websites or tools. Your use of a third-party service is governed by that provider’s terms and privacy policy. We are not responsible for third-party services, including their availability, accuracy, content, or data practices. AI model availability, capabilities, and pricing may change, and a model or feature may be discontinued.
12. Paid features, credits, and billing
Some features require credits or a paid plan. The pricing page or checkout shows the applicable price, currency, credits, plan benefits, billing period, and any material conditions before you purchase. You authorize us and our payment processor to charge your selected payment method for the amount shown, including applicable taxes. You are responsible for any taxes, duties, or fees not collected by us. Credits are non-transferable, have no cash value, and may be used only through the Service. Credits do not expire unless we state otherwise at purchase. If we offer subscription plans, they renew automatically at the interval shown at checkout until you cancel. You can cancel through your account or by contacting us. Cancellation stops future renewals; access continues until the end of the current paid period. We may change prices or plan features with notice, and changes apply to future billing periods. If you believe a charge is incorrect, contact us before initiating a chargeback so we can investigate.
13. Refunds and withdrawal rights
Except where required by applicable law, purchases of credits and paid plans are non-refundable once payment is confirmed and the credits or access have been made available. If you were charged twice, did not receive a purchased entitlement because of a technical error, or believe a charge was unauthorized, contact [email protected] within 14 days with the order details. We may reverse related credits or access when we issue a refund. If you are a consumer in the European Union or the United Kingdom, you generally have 14 days to withdraw from a distance contract. Where required, we will ask you to expressly request immediate performance before you access digital content or credits; by doing so, you acknowledge that you lose the withdrawal right once performance begins. If you have not used the digital content or credits, you may contact us to request a refund. Nothing in these Terms limits mandatory consumer rights in your country.
14. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, AND WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT OUTPUTS WILL MEET YOUR EXPECTATIONS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) USD 100 OR (B) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. NOTHING IN THESE TERMS LIMITS LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, OR ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED BY LAW. MANDATORY CONSUMER RIGHTS ARE NOT AFFECTED.
16. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Promptora and its affiliates, officers, employees, and agents from and against claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: your User Content; your use of the Service; your violation of these Terms, applicable law, or third-party rights; or your AI-generated outputs. We may assume the defense of any matter subject to indemnification, and you agree to cooperate. This section does not apply to consumers where such an obligation would be prohibited by law.
17. Termination
We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms, pose a risk to the Service or others, or if we are required to do so by law. We may also discontinue the Service or a feature. You may stop using the Service at any time and request deletion of your account. On termination, your license to use the Service ends. Sections that by their nature should survive, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law, will survive. We may delete your User Content after a reasonable period. If we terminate for your violation, unused credits may be forfeited to the extent permitted by law; if we terminate for our convenience, we will refund unused prepaid amounts on a pro rata basis.
18. Governing law and disputes
These Terms are governed by the laws of Singapore, without regard to conflict-of-laws principles. Subject to the paragraph below, the courts of Singapore have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service. If you are a consumer, you may also bring a claim in the courts of your country of residence, and you keep the benefit of any mandatory consumer protections in your country. Before filing a claim, please contact us at [email protected] so we can try to resolve the issue informally. Nothing in this section prevents either party from seeking urgent injunctive or equitable relief.
19. Changes to the Service and these Terms
We may modify, suspend, or discontinue any part of the Service. We may also update these Terms from time to time. We will post the updated Terms on this page and change the effective date at the top. If a change is material, we will provide additional notice where required by law. Continued use of the Service after the effective date means you accept the updated Terms to the extent permitted by law. If you do not agree to the updated Terms, stop using the Service.
20. General
These Terms, together with our Privacy Policy and any additional terms shown at checkout or in the Service, are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not responsible for delays or failures caused by events beyond our reasonable control. Notices to you may be sent by email or posted in the Service. The English version of these Terms controls if there is a conflict with a translation.
